Bakalářská práce charakterizuje obecnou problematiku trestního práva procesního a s ním souvisejícím trestním řízením. Zabývá se postavením svědka v trestním řízení, jeho obecnými náležitostmi, možností odepření výpovědi, právy a povinnostmi svědka a v neposlední řadě i problematikou postavení dítěte jako svědka v trestním řízení. Výsledkem práce je stanovení doporučujícího postupu a několika základních pravidel přístupu k výslechu osoby mladší patnácti let, které vychází ze skutečnosti, že ke každému dítěti je třeba přistupovat individuálně.
Anotace v angličtině
This bachelor thesis deals with the general problems of the law of criminal procession having connection with a criminal procedure. It depicts the position of a witness in a criminal procedure, general terms, possibilities of a withhold of a testimony, rights and duties of a witness in a criminal procedure. It also deals with the situation of a child being a witness in a criminal procedure. The conclusion of this work is a recommended approach in the examination of witnesses younger than 15. These recommendations are based on the fact that every child is an individuality.
