Tato bakalářská práce je zaměřena na srovnání restorativního (obnovujícího) a retributivního (odplatného) pojetí trestní spravedlnosti. Zabývá se zavedením alternativních sankcí do trestně právních kodexů v průběhu posledního desetiletí. Upozorňuje na možné psychické a sociální důsledky trestu odnětí svobody pro odsouzené a současně poukazuje na možnosti, jež skýtá uplatnění alternativních sankcí při trestání osob, jež se dopustili trestného činu menší společenské nebezpečnosti. Současně poukazuje na ekonomické důsledky alternativních trestů, v dlouhodobé perspektivě snížení nákladů v oblasti vězeňství.
Bakalářská práce mapuje alternativní tresty a opatření v rámci restorativní justice v České republice a poukazuje na roli nového subjektu v rámci resortu Ministerstva spravedlnosti ČR Probační a mediační služby při řešení trestních věcí .
Annotation in English
This bachelor´s thesis is focused on the comparison of the restorative and retributive conception of the criminal justice. It deals with the implementation of alternative sanctions in the criminal law codices in the course of the last decade. It warns of the possible psychical and social consequences of imprisonment for convicts and concurrently refers to the possibilities, which the application of alternative sanctions in person´s punishment provides, who committed a crime of lesser social dangerousness. Concurrently it points out the economical consequences of alternative punishments, in long-term perspective the costs reduction in the sphere of penal system.
The bachelor´s thesis describes the alternative punishments and measures within the restorative justice in the Czech Republic and points out the role of a new subject within the resort of the Czech Republic Ministry of Justice Probation and mediation service in solution of criminal cases.
