Tato práce pojednává komplexním způsobem o soutěžním právu v Evropské unii a České republice. Teoretická část je zaměřena na seznámení se s problematikou soutěžního práva, historií i jeho právní úpravou. Zabývá se nejen způsoby omezení hospodářské soutěže, ale i nástroji ochrany, které mají v rukou soutěžní orgány. Pozornost je dále věnována institucím, které působí na úseku soutěžního práva a jejich spolupráci v rámci Evropské unie i mimo ni. Na poznatky získané v teoretické části diplomové práce navazuje praktická část, která pojednává o vztahu evropského a českého soutěžního práva, procesních postupech Úřadu pro ochranu hospodářské soutěže, i možnostech obrany proti jeho rozhodnutí. Diplomová práce je zakončená částí, ve které je upozorněno na oblasti, v nichž je možno zeefektivnit činnost Úřadu pro ochranu hospodářské soutěže. Cílem práce je zhodnotit ochranu hospodářské soutěže a činnost Úřadu pro ochranu hospodářské soutěže v souvislosti se specifiky evropského soutěžního práva.
Annotation in English
This thesis discusses a comprehensive way of competition law in the European Union and the Czech Republic. The theoretical part is focused on introducing the issue of competition law, legal history and its treatment. It deals with ways of restricting competition, as well as protection mechanisms, which the competition authorities deals with. Attention is also given to institutions operatting whithin the competition and their cooperation within and outside the European Union. Practical part follows up whith the knowledge acquired in the theoretical part of this thesis, and deals with the relationship of European and Czech competition law, procedural practices of the Office for the protection of competition, as well as the possibilities of resisting his decision. The last part of the thesis draw attention to the area in which it is possible to improve protection of The Office for the protection of competition. The aim of the thesis is to evaluate protection of competition and activities of the Office for the protection of competition according to specifics of European competition law.
