Záměrem práce je zjistit, jaká je společenská efektivnost právní normy, kterou je střídavá a společná výchova na základě § 26 zákona č. 91/1998 Sb. Do jaké míry může tato norma regulovat rodinné vztahy. Vyhodnotit a odůvodnit rozdílnost názorů týkajících se problematiky střídavé a společné výchovy a toto vyhodnocení konfrontovat jak se záměrem sledovaným právní normou, tak s výsledky právní praxe. Zároveň je tato práce i odůvodněním nutnosti, aby bylo dosaženo opravdu objektivního zhodnocení, akceptace výkladu právní normy, názorů všech zúčastněných ?oborů a vědeckých disciplín?, stejně tak orgánů s rozhodujícími pravomocemi. Stejnou měrou je zde snaha o interpretaci zjištěných závěrů, jejichž syntézou by mohly být odpovědi, které mohou pomoci řešit problémy, posunout vnímání.

The main aim of this work is to find out how hight is the social effectivity of law of shared parenting and child custody on the basis of § 26 zákona č. 91/1998 Sb. It determines the degree of regulation of family relationships. This work evaluates and gives reasons for the divergence of opinions involving problems with shared parenting and child custody. The evaluation is confronted not only with the intent which is monitoring by law, but also with results of legal practise. At the same time the thesis justifies the necessity to achieve the objective evaluation, acceptation of the interpretation law, opinions of participatory ?branches and scientific disciplines? as well as decisive authority power. This work tries to interpret established conclusion to the same extent. The conclusion deals with the problems, their answers could be the synthesis that solve problems and transfer perception.
