Předkládaná diplomová práce se věnuje problematice alternativních trestů, zejména pak je zaměřena na trest obecně prospěšných prací jako na jeden z možností trestání pachatelů. V současné době, kdy jsou věznice přeplněné, je toto téma velmi aktuální. Diplomová práce je rozdělena do dvou hlavních částí - teoretické a praktické. V teoretické části své práce popisuji alternativy, které se uplatňují při řešení trestné činnosti. Naznačuji vývoj alternativních trestů v České republice. Svou pozornost věnuji také zahraniční právní úpravě. Podávám přehled právní úpravy tohoto institutu v několika evropských zemích a provedla jsem i srovnání s českou právní úpravou. Podstatná část práce se soustředí na platnou právní úpravu trestu obecně prospěšných prací. Zdůrazňuji některé problémy týkající se aplikace tohoto trestu a samozřejmě zmiňuji i relevantní právní pojmy. V praktické části se pomocí sekundární analýzy snažím najít odpovědi na následující otázky: Jak jsou tresty obecně prospěšných prací opravdu vykonávány (jaké práce jsou jejich náplní)? Kolik uložených trestů obecně prospěšných prací je přeměněno na nepodmíněný trest odnětí svobody? Jaký je nejčastější důvod nevykonání a následné přeměny trestu? Abych získala tyto odpovědi, provedla jsem analýzu dat z náhodně vybraných soudních spisů u Městského soudu v Brně a její vyhodnocení.

This thesis is devoted to the alternative punishments, especially it is focused on the community service order as one of the possible sentence of the offenders. Nowadays this theme is up-to-date because of the overcrowded prisons. My thesis is devided into two main parts - the theoretical one and the practical one. In the theoretical part of the thesis I describe alternatives which are used in solving the crimes. I also outline a history of the alternative punishments in the Czech republic. I pay my attention on the foreign legal regulation as well. I delineate a legislative in several european states and made a little comparation with the Czech legislation. The substantial part of my thesis is concentrated on the valid legal regulation of the sentence of community service. I point out some problems concerning with the application of this penalty and of course I mention the relevant legal terms. In the practical part, by secondary analyses, I try to find out the answers to the following questions: How the sentences of the community service order are really executed (what works are their filling)? How many imposed sentences of community service are commuted to the unconditional sentence? What is the most frequent reason of unexecuting and then commuting the sentence? To gain these replies I analysed and interpreted the data from the judicial records selected at random in the Metropolitan Court in Brno.
